First and foremost, it must be clearly stated that H.R. 350 is unconstitutional. Congress has no authority to pass a law that violates the United States Constitution without an amendment to the Constitution. Article 1, Section 8, gives no authority to Congress to pass such a law. In addition, H.R. 350 is a direct assault on the 1st Amendment of the Constitution.
Here are a few of major concerns with this bill:
- Democrat Party leadership and various members of Congress have used tied the H.R. 350 directly to the Capitol breach on January 6, 2021 calling it “Domestic Terrorism“. The media reporting of that day have been demonstrably false. As the actual facts come out that is being proven, yet everyone who was even at the Capitol that day is being labeled a Domestic Terrorist. Add to that the fact that ANTIFA and BLM rioters are not subjected to that label, and it is clear this is a politically driven bill to silence anyone who disagrees with the radical ideology of the Communist/Socialist elitists. - It is unnecessary. There is absolutely no justifiable reason to create a new law when there are already laws in place to deal with criminal behavior. If justice would simply be allowed to lawfully take its course under the current laws of the land, justice would be served–not based on politics, but based on the actual crime committed.
- H.R. 350 is a clear diversion from the central focus of the true work of the Congress. It is divisive, destructive, and harmful to the lives and freedoms of American citizens.

“The Department of Homeland Security will require state and local grant recipients to spend funding on domestic violent extremism prevention efforts, the department announced Thursday.”
“Those who read the bill aren’t so gung ho to shred the Constitution.”
“The irony of this bill title is that it is not about preventing terrorism; it is about legalizing terrorism by the state against the citizenry. It would be more appropriately titled the U.S. Government Terrorism Authorization Act of 2021.”
“To paraphrase the great sage Samuel Johnson, nothing concentrates the mind of a member of Congress like the prospect of being hanged in a mass assault on the U.S. Capitol.”
“The DTPA is essentially the criminalization of speech, expression, and thought. It takes cancel culture a step further and all but outlaws unpopular opinions. This act will empower intelligence, law enforcement, and even military wings of the American ruling class to crack down on individuals adhering to certain belief systems and ideologies.”
Attorney General William Barr issued a statement Sunday on “riots and domestic terrorism.” In it, he states, “The violence instigated and carried out by Antifa and other similar groups in connection with the rioting is domestic terrorism and will be treated accordingly.”
