These Terms and Conditions (“Terms”) govern your access to and use of the Moms For America website and related online services (the “Service”), operated by Moms For America, a Missouri nonprofit organization (“Moms For America,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

 

1. Use of the Website

You agree to use the Service only for lawful purposes and in a manner consistent with our mission. You may not use the Service in any way that violates applicable laws or regulations, attempt to interfere with the operation or security of the Site, or use the Site to distribute malicious software or harmful content. We reserve the right to restrict or terminate access for misuse.

 

2. Donations, Purchases, and Payments

If you make a donation, purchase merchandise, or register for an event through the Service, you may be required to provide payment information. You represent that you are authorized to use the payment method provided and that all information submitted is accurate and complete. Payments are processed through third-party payment processors. We do not store full payment card information. We reserve the right to refuse or cancel transactions in cases of suspected fraud, errors, or violations of these Terms. Unless otherwise stated, donations are non-refundable to the extent permitted by law.

 

3. Availability and Accuracy of Information

We strive to provide accurate and up-to-date information, but the Service may occasionally contain errors, omissions, or outdated content. We reserve the right to correct or update information at any time without notice.

You agree to indemnify and hold harmless Moms For America, its officers, directors, employees, volunteers, and agents from any claims, damages, losses, liabilities, or expenses including reasonable attorneys’ fees arising out of your use or misuse of the Service, your violation of these Terms, or any content you submit through the Service.

 

9. Limitation of Liability

To the fullest extent permitted by law, Moms For America shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free access to the Service or that it will be free from harmful components. Content provided through the Service is for informational and educational purposes only and does not constitute legal, medical, financial, or professional advice.

Moms For America does not guarantee specific results, outcomes, or impacts from participation in our programs, campaigns, or initiatives. Engagement and outcomes depend on many factors beyond our control.

 

12. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of God, war, government actions, labor disputes, or failures of third-party service providers.

 

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Missouri.

 

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use personal information.

 

15. Children’s Privacy

The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If such information is discovered, it will be deleted promptly.

 

16. User Content and Testimonials

If you submit comments, testimonials, photos, or other content, you grant Moms For America a non-exclusive, royalty-free license to use, display, and share that content for nonprofit, educational, or promotional purposes unless you request otherwise. You may request removal of testimonials by contacting us.

The Service is operated from the United States. By using the Service, you consent to the transfer and processing of information in the U.S. and other jurisdictions where service providers operate.

20. Miscellaneous
